Texas — what makes it different
Texas is the only state where workers' comp is optional for private employers. "Non-subscriber" employers are open to direct injury lawsuits.
Real example: how the Texas cap works
A worker earning $2270/week in Texas (above-average wage):
- Raw formula: $2270 × 70% = $1589.00/week
- Texas cap kicks in: $1135.00/week
- Effective replacement rate: 50.0% of pre-injury wage (not 70%)
For a 26-week disability, that's $29,510 in total TTD benefits — substantially less than what 70% of full wage would pay.
If a third party contributed to the injury, the difference between full wage and capped benefit becomes part of a separate third-party personal injury claim.
